Terms and Conditions:

The purchase of products from the website is governed by these terms and conditions. By accessing the site and ordering goods, you agree to be bound by these terms and conditions. The products supplied from this website are manufactured and packaged by Marie’s Bakehouse/Risky Biscuit UK. All goods remain the property of Marie’s Bakehouse/Risky Biscuit UK until paid for in full. Any email or other electronic acknowledgement by or of receipt of an order placed by you does not constitute legal acceptance of your order. 

When an order has been submitted on the website, I can reject it for any reason, although I will try and inform you of the reason without delay. 

The order process is set out on the website. Each step allows you to check and amend any errors before submitting. It is your responsibility to check that you have used the ordering process correctly, and details including delivery address are correct. 

Prices and Availability

The price of the goods and any additional delivery or other charges is as set out on the website at the date of the order. My products and prices are subject to change at any time. I work hard to keep the website prices as accurate as possible, however I cannot accept orders if I find there is an error either in the description of the goods or the price advertised. If I discover an error after you have placed an order, I will contact you as soon as possible and give you the choice to cancel your order or to complete it at the correct price. If I am out of stock of a particular product I will contact you to advise and offer an appropriate substitute if available. 

The description of the Goods is as set out in the website or any form of advertisement. Any description is for illustrative purposes only and there may be small discrepancies on the size or colour of the Goods supplied. All Goods which appear on the website are subject to availability.

Delivery

I will aim to dispatch all orders as soon as possible but this may take up to 3 working days for cookies and 5 working days for cake toppers. Delivery would usually be 1-3 days for first class postage, and 3-5 days for second class postage. In the times of Covid 19, delivery times may be longer. These shipping times are based on Royal Mail postage times. I am currently organising a next day option with DPD, shipping times and prices will be adjusted when this is formalised.

I cannot guarantee delivery dates. Please order in good time for the date you need. It is better to receive an early present rather than a late one.

If you would like a delayed dispatch please let me know by using the additional information box on the checkout page and I will aim for that. Please note, we cannot guarantee delivery on a specific day. 

Goods are not packed in a way which is “pet proof”. I can accept no liability for goods damaged as a result of a pet gaining access to the goods, or for a pet consuming the goods.  In the current climate, boxes may be left on doorsteps or porches. I cannot take responsibility for any damage caused due to weather. I cannot accept liability for delays in delivery resulting from circumstances outside my control e.g delays to delivery due to the weather.

Privacy and security

I will retain and use all personal information provided by you strictly as detailed in our privacy policy. At no time will any of your information be sold to a third party.

I may only contact you by using email or other electronic communication methods if you have agreed to this.

Returns and refunds

I hope you would never find need to want to return any of my products, but as they are perishable items, unfortunately I cannot accept any returns. Under the Distance Selling Regulations (2000) retail customers have the legal right to cancel an order within seven working days of receipt of the goods. Perishable goods (ie. cakes and baked goods) and any baked to order cakes are excluded from these regulations and cannot be returned unless faulty. 

However, if there are any issues with your order, please contact me as soon as possible and I will work with you to resolve the problem. If the order is defective or damaged, it can be exchanged for the same item, please send me an email with photographs of the item to marie@mariesbakehouse.co.uk

If at any time you are not completely satisfied with my products, please contact marie@mariesbakehouse.co.uk to let me know. I will do my best to fix the problem and make sure that it doesn’t happen again. Unfortunately if the product has been eaten I cannot tell what, if anything, might have been wrong with it. 

You can cancel your order within 24 hours of ordering. To cancel, please email marie@mariesbakehouse.co.uk quoting your order reference. I will refund your money, if paid, as soon as possible. You do not have to give a reason for cancellation, but to help us improve the service I offer customers in the future, a brief explanation would be useful. 

This cancellation policy does not affect your legal rights, for example if goods are faulty.

Liability

If there is a fault with the goods on your order, I may ask you to return the goods to me for examination, so I can work out what has gone wrong and ensure that the problem does not reoccur. If items are faulty I will either send replacements, or refund the value of the goods. My liability in all cases is limited to the value of the goods purchased. I hereby exclude liability for any consequential loss, whether arising from the use of goods purchased, the late or non delivery or any other cause. 

Bespoke celebration and wedding cakes

These terms form the basis of the contract between you and Marie’s Bakehouse.  Any breach of these conditions will constitute a breach of contract and may terminate the contract with no redress on, or liability to Marie’s Bakehouse.

Basis of Sale

These Terms, your Order and Order confirmation are considered by myself to set out the whole agreement between you and myself for the sale of cakes. Please check all details in the order confirmation are complete and accurate as this is the document I work to when completing your order. These Terms shall become binding on you and I when a non refundable deposit is paid and an order confirmation is issued, at which point a contract shall come into existence between us.

Any samples, drawings or descriptions I issue including descriptions or illustrations contained on my website or social media profiles are issued solely to provide an approximate idea of the cake they describe.

Any quotations are valid for a period of 30 calendar days from its day of issue. Prior to 14 days before delivery for celebration cakes, and 28 days before for wedding cakes, you may amend or cancel your order by providing written notice to marie@mariesbakehouse.co.uk . In the case of alterations a new order confirmation will be issued detailing the changes and the new cost. Requested alterations are not confirmed until a new order confirmation has been issued. In the event of a cancellation any payments previously made are non refundable.

In the unlikely event that I need to cancel your order and cannot transfer the booking to an alternative local decorator, any deposits paid will be fully refunded to you. No further liability will be sought. Possible reasons for cancellation include but are not limited to; death, injury, illness (due to health and safety regulations), serious medical condition or accident to myself or family member.

The Cakes

On delivery or collection the cakes shall conform to their description as set out in the Order Confirmation, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. I will not be held responsible for customer interpretation of the cakes as long as it is made in line with the customer’s agreed requirements set out in the Order Confirmation and will face no consequent liability.

The warranty does not apply to any defect in the cakes arising from wilful damage, accident, negligence by you or any third party, if you use the cake in a way I do not recommend, your failure to follow my instructions about carrying, transporting or storing the cake, or any alterations you carry out.

As my cakes are made in an environment where nuts are present, I cannot guarantee that any cake is entirely nut free. I will provide a list of ingredients and allergens used in the cake.

I cannot guarantee an exact replica of any cake. Where colour swatches are provided I will do my best to match as closely as I can. Exact colour matches are not guaranteed due to the nature of food colourings.  From time to time certain materials for my cakes may become obsolete e.g. a particular colour ribbon. This is totally out of my control; however I will do my best to select replacement products to reflect the original design as closely as possible. In all cases I will try and contact you to advise on any changes; however I reserve the right to replace items with component parts of equal or better quality without consultation.

If your cake contains flowers or figures made from sugar paste, whilst edible, I do not advise that they be eaten due to the possible presence of dowels for reinforcement. I will inform you if any such materials have been used. Due to the handmade nature of my models, whilst I try to capture the characteristics of a particular person I cannot guarantee a true likeness.

The cake is a fresh product containing no additives or preservatives and it is my right to assume consumption on the day requested. Most cakes will last at least three days after cutting, but this cannot be guaranteed. Cakes should be stored in a dry place, at room temperature, away from direct sunlight and sources of heat, in the box provided. Please see the cake information sheet provided with the cake for any extra storage requirements. Unless stated cakes should not be refrigerated.

In the unlikely event you are unhappy with the quality of the cake produced, you must contact Marie’s Bakehouse within 24 hours and preserve a sample of the cake by wrapping it tightly in cling film and storing as set out above for analysis.

Delivery

I accept no responsibility for any damage sustained to the cake once it has been delivered. I will deliver the cake on the day set out in the order confirmation to the address provided. I cannot always offer specific delivery times.

When delivering to a wedding venue I will contact the venue in advance to arrange a mutually convenient time for delivery. If I set up the wedding cake, I shall take a photograph of the cake before leaving and where possible, obtain a signature from the venue confirming the cake has been received in good condition. Should the venue need to set up the cake I will explain how the cake is to be displayed and obtain a signature to verify this has been done. Once the cake has been delivered, I am unable to accept liability for any damage sustained to the cake thereafter nor any failure to follow the instructions provided.

Price and Payment

The price of your cake will be set out in your order confirmation. Order confirmation will be issued detailing the deposit, balance and payment details. No further payment reminders will be sent and it is the responsibility of the client to ensure payment is on time.

A £50 deposit is required to secure the date for a wedding cake booking. Once a design has been agreed 50% of the order value is payable. For any other cakes and smaller orders 50% of the order value is payable on ordering, this forms a non refundable deposit and secures the date.

The balance must be paid in cleared funds no later than the date set out in the order confirmation by bank transfer to the account specified. This is usually 2 weeks prior to a celebration cake collection or delivery and 4 weeks prior to a wedding cake delivery.

If payment is not received by the date specified this shall be constituted as a breach of contract by the client. I reserve the right to hold the order until payment is made in full. When payment is late I accept no responsibility should I be unable to purchase the required stock or equipment to make the cake as laid out in the order confirmation. In these circumstances the cake will be made as close to the order confirmation as possible with no redress or liability on Marie’s Bakehouse.

General Terms

All designs remain the property of Marie’s Bakehouse.

I reserve the right to use images of your cake for any form of advertising, web based promotions, brochures, galleries and competitions.

It is advisable that you make a copy of all documentation received from Marie’s Bakehouse for your own benefit.

All of the above agreements apply to all of my work.

Terms and conditions may change at any time but will not affect your contract with Marie’s Bakehouse. This does not affect your statutory rights.
